Data Processing Agreement

1. Scope

This Data Processing Agreement (DPA) applies to enterprise customers using GatherSnaps for corporate events. It describes how GatherSnaps processes personal data on your behalf.

2. Roles and Responsibilities

Data Controller (You): You determine the purposes and means of data processing.

Data Processor (GatherSnaps): We process data only as instructed by you, in accordance with this agreement and applicable law.

3. Data Processing

GatherSnaps processes the following types of data:

• Attendee names, emails, and avatars
• Photos and videos uploaded during events
• Comments, reactions, and engagement data
• Device and location information (if permitted)

4. Data Security

GatherSnaps implements appropriate security measures including:

• Encryption of data in transit (HTTPS/TLS)
• Secure storage with access controls
• Regular security audits and assessments
• Incident response procedures

5. Data Retention and Deletion

Data is retained as long as necessary to provide Services. Upon termination of the enterprise agreement, you may request complete data deletion. GatherSnaps will delete or return personal data within 30 days, except where retention is required by law.

6. Your Rights

You have the right to request from GatherSnaps:

• Access to all personal data we process on your behalf
• Correction of inaccurate data
• Deletion of data (subject to legal retention requirements)
• Data portability in a structured format
• Restriction of processing

7. Subprocessors

GatherSnaps uses the following subprocessors to assist in data processing: hosting providers, analytics services, and email delivery services. We maintain a current list of subprocessors and notify you of any changes.

8. International Transfers

If data is transferred internationally, GatherSnaps ensures appropriate safeguards such as Standard Contractual Clauses or your explicit consent.

9. Audit Rights

You have the right to audit GatherSnaps' compliance with this DPA. We will provide documentation and evidence upon reasonable request.
